Sole trader with consumer rights – a natural person concluding a contract directly related to their business where the contract shows it is not of a professional nature for them (Art. 7aa of the Polish Consumer Rights Act). The Consumer provisions on withdrawal, lack of conformity and unfair terms apply to them. Terms – this document, available free of charge in the Shop in a form that can be downloaded and saved.
§3. Electronic services and technical requirements 1. Free of charge, the Seller provides electronically: browsing the catalogue, the order form, the Customer Account, the contact form and messages (chat), the quote request form and the service request form. 2. Using the Shop requires a device with Internet access, an up-to-date web browser with cookies enabled and an active e-mail address. 3. A Customer Account is free; orders can also be placed without one. The Account contract is concluded for an indefinite period; the Customer may terminate it at any time by writing to biuro@optek.pl. 4. Providing unlawful content is prohibited. 5. Complaints about the electronic services can be sent to biuro@optek.pl; the Seller answers within 14 days.
§4. Prices and orders 1. Prices are in Polish złoty and are gross prices (VAT included). The delivery cost is shown in the cart before the order is placed. 2. For a reduced price, the Seller also shows the lowest price from the 30 days before the reduction. 3. To order, the Customer adds products to the cart, gives delivery details (and invoice details if needed), chooses delivery and payment, accepts these Terms and clicks "Order with an obligation to pay". 4. After the order is placed, the Customer receives an e-mail confirming it. The sale contract is concluded at that moment. 5. Products marked "price on request" are sold on the basis of an individual quote.
§5. Payment 1. The available payment methods are shown with the order and include: BLIK and instant online transfer (processed by Krajowy Integrator Płatności S.A. – Tpay), a standard bank transfer to the Seller's account and – where available – cash on delivery. 2. For a standard bank transfer, payment is due within 14 days of the order; after that the Seller may cancel the order. 3. The Seller issues a receipt or a VAT invoice.
§6. Delivery 1. The Seller ships within Poland by the carriers shown in the cart (including Poczta Polska, courier and InPost) or makes the goods available for collection in Ziębice. 2. The fulfilment time is shown with each product; it runs from the moment payment is credited or, for cash on delivery, from the moment the order is placed. 3. The Customer should check the parcel on receipt and report transport damage to the carrier (damage report); this does not limit a Consumer's rights.
§7. Right of withdrawal 1. A Consumer and a sole trader with consumer rights may withdraw from the contract without giving a reason within 14 days of receiving the goods. It is enough to send a statement before the deadline, e.g. by e-mail to biuro@optek.pl (the model form annexed to the Consumer Rights Act may be used). 2. The goods must be returned to the Seller's address without undue delay and no later than 14 days after withdrawal. The Customer bears the direct cost of returning them. 3. The Seller refunds all payments, including the cheapest standard delivery cost, within 14 days of receiving the statement, using the same payment method unless the Customer agrees otherwise. The Seller may withhold the refund until it receives the goods or proof that they were sent back. 4. The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. 5. The right of withdrawal does not apply, among others, to goods made to the Customer's specifications or clearly personalised, and to sealed goods that cannot be returned for health protection or hygiene reasons once unsealed.
§8. Complaints 1. Towards a Consumer, the Seller is liable for the conformity of the goods with the contract under the Consumer Rights Act, for a lack of conformity that becomes apparent within 2 years of delivery. 2. Towards other Customers, the Seller is liable under the statutory warranty (rękojmia) of the Polish Civil Code. 3. A complaint can be sent by e-mail to biuro@optek.pl or in writing to the Seller's address, describing the defect and what the Customer requests. The Seller answers within 14 days. 4. Where the manufacturer gives a guarantee, its terms are in the guarantee card; a guarantee does not limit statutory rights.
§9. Service Repairs and maintenance are carried out on the basis of a service request. Before a repair, the Seller provides a quote and starts the work only after the Customer accepts it.
§10. Out-of-court dispute resolution A Consumer may seek help from a municipal or district consumer ombudsman, the regional Trade Inspection (Inspekcja Handlowa) or consumer organisations. Information: uokik.gov.pl.
§11. Personal data The processing of personal data is described in the Privacy policy available in the Shop.
§12. Final provisions 1. Contracts are concluded in Polish under Polish law; this does not deprive a Consumer of the protection given by mandatory provisions of the law of their country. 2. The Seller may change these Terms for important reasons (e.g. a change in the law, payment or delivery methods). Orders placed before a change are governed by the previous Terms. 3. These Terms do not limit a Consumer's statutory rights. 4. The Polish version is binding; this English version is a translation.
